THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
We understand the importance of privacy and are committed to maintaining the confidentiality, integrity, and security of your medical and personal information. When we provide telehealth, pharmacy, and related healthcare services, we create and maintain a record of the care and services we provide and may receive medical records and other health information from other providers and organizations.
When we refer to your “medical information” or “health information” in this Notice, we mean information that identifies you and relates to your past, present, or future physical or mental health or condition, the provision of health care to you, or payment for that care. This information is often called “protected health information” or “PHI” under the Health Insurance Portability and Accountability Act (“HIPAA”).
We are required by law to maintain the privacy of your protected health information, provide you with this Notice of our legal duties and privacy practices, and notify you if a breach occurs that compromises the privacy or security of your unsecured protected health information. This Notice describes how we may use and disclose your medical information and explains your rights and our legal obligations with respect to that information. A. How This Medical Practice May Use or Disclose Your Health Information
This medical practice collects health information about you and stores it in paper and electronic form, including electronic health record and telehealth systems. This is your medical record. The medical record is the property of this medical practice, but the information in the medical record belongs to you. The law permits us to use or disclose your health information for the following purposes:
1. Treatment.
We use and disclose medical information about you to provide, coordinate, or manage your medical care. We disclose medical information to our employees and others who are involved in providing the care you need. For example, we may share your medical information with other physicians or other health care providers who will provide services that we do not provide, with a pharmacist who needs it to dispense a prescription to you, or with a laboratory that performs a test. We may also disclose medical information to members of your family or others who can help you when you are sick or injured, or after you die, as permitted by law and consistent with your preferences.
2. Payment.
We use and disclose medical information about you to obtain payment for the services and products we provide. For example, we may give your health plan the information it requires before it will pay us. We may also disclose information to other healthcare providers to assist them in obtaining payment for services they have provided to you.
3. Health Care Operations.
We may use and disclose medical information about you for our health care operations. For example, we may use and disclose this information to review and improve the quality of care we provide, or the competence and qualifications of our professional staff, or to get your health plan to authorize services or referrals. We may also use and disclose this information as necessary for medical reviews, legal services, and audits, including fraud and abuse detection and compliance programs, and business planning and management.
We may share your medical information with our “business associates,” such as our billing service or technology vendors, that perform administrative or technical services for us. We have a written contract with each of these business associates that contains terms requiring them and their subcontractors to protect the confidentiality and security of your protected health information and to use it only for the services they provide to us.
We may also share your information with other health care providers, health care clearinghouses, or health plans that have a relationship with you, when they request this information to help them with their quality assessment and improvement activities, patient-safety activities, population-based efforts to improve health or reduce health care costs, protocol development, case management or care-coordination activities, review of competence, qualifications and performance of healthcare professionals, training programs, accreditation, certification or licensing activities, or health care fraud and abuse detection and compliance efforts.
4. Notification and Communication With Family.
We may disclose your health information to notify or assist in notifying a family member, your personal representative, or another person responsible for your care about your location, your general condition or, unless you have instructed us otherwise, in the event of your death. In the event of a disaster, we may disclose information to a relief organization so that they may coordinate these notification efforts. We may also disclose information to someone who is involved in your care or helps pay for your care.
If you are able and available to agree or object, we will give you the opportunity to object prior to making these disclosures, although we may disclose this information in a disaster even over your objection if we believe it is necessary to respond to emergency circumstances. If you are unable or unavailable to agree or object, our health professionals will use their best judgment in communicating with your family and others.
5. Marketing.
Provided we do not receive any payment from a third party for making these communications, we may contact you to give you information about products or services related to your treatment, case management, or care coordination, or to direct or recommend other treatments, therapies, health care providers, or settings of care that may be of interest to you. We may similarly describe products or services provided by this practice and tell you which health plans this practice participates in. We may also encourage you to maintain a healthy lifestyle and get recommended tests, participate in a disease management program, provide you with small gifts, tell you about government-sponsored health programs, or encourage you to purchase a product or service when we see you, for which we may be paid.
We may receive compensation which covers our cost of reminding you to take and refill your medication, or otherwise communicate about a drug or biologic that is currently prescribed for you. We will not otherwise use or disclose your medical information for marketing purposes or accept any payment for other marketing communications without your prior written authorization. Any such authorization will disclose whether we receive any compensation for any marketing activity you authorize, and we will stop any future marketing activity to the extent you revoke that authorization.
6. Sale of Health Information.
We will not sell your health information without your prior written authorization. Any such authorization will disclose that we will receive compensation for your health information if you authorize us to sell it, and we will stop any future sales of your information to the extent that you revoke that authorization.
7. Required by Law.
As required by law, we will use and disclose your health information, but we will limit our use or disclosure to the relevant requirements of the law. When the law requires us to report abuse, neglect, or domestic violence, or respond to judicial or administrative proceedings, or to law enforcement officials, we will further comply with the requirements set forth below concerning those activities.
8. Public Health.
We may, and are sometimes required by law, to disclose your health information to public health authorities for purposes related to preventing or controlling disease, injury, or disability; reporting child, elder, or dependent adult abuse or neglect; reporting domestic violence; reporting to the Food and Drug Administration problems with products and reactions to medications; and reporting disease or infection exposure.
When we report suspected elder or dependent adult abuse or domestic violence, we will inform you or your personal representative promptly unless, in our best professional judgment, we believe the notification would place you at risk of serious harm or would require informing a personal representative we believe is responsible for the abuse or harm.
9. Health Oversight Activities.
We may, and are sometimes required by law, to disclose your health information to health oversight agencies during the course of audits, investigations, inspections, licensure, and other proceedings, subject to the limitations imposed by law.
10. Judicial and Administrative Proceedings.
We may, and are sometimes required by law, to disclose your health information in the course of any administrative or judicial proceeding to the extent expressly authorized by a court or administrative order. We may also disclose information about you in response to a subpoena, discovery request, or other lawful process if reasonable efforts have been made to notify you of the request and you have not objected, or if your objections have been resolved by a court or administrative order.
11. Law Enforcement.
We may, and are sometimes required by law, to disclose your health information to a law enforcement official for purposes such as identifying or locating a suspect, fugitive, material witness, or missing person; complying with a court order, warrant, grand jury subpoena, or other law enforcement purposes.
12. Coroners.
We may, and are often required by law, to disclose your health information to coroners and medical examiners in connection with their investigations of deaths.
13. Organ or Tissue Donation.
We may disclose your health information to organizations involved in procuring, banking, or transplanting organs and tissues.
14. Public Safety.
We may, and are sometimes required by law, to disclose your health information to appropriate persons in order to prevent or lessen a serious and imminent threat to the health or safety of a particular person or the general public.
15. Specialized Government Functions.
We may disclose your health information for military or national security purposes or to correctional institutions or law enforcement officers that have you in their lawful custody, as permitted by law.
16. Workers Compensation.
We may disclose your health information as necessary to comply with worker's compensation laws. For example, to the extent your care is covered by worker's compensation, we will make periodic reports to your employer about your condition. We are also required by law to report cases of occupational injury or occupational illness to the employer or worker's compensation insurer.
17. Change of Ownership.
In the event that this medical practice is sold, merged, or combined with another organization, your health information/record will generally become the property of the new owner, although you will maintain the right to request that copies of your health information be transferred to another physician or medical group.
18. Breach Notification.
In the case of a breach of unsecured protected health information, we will notify you as required by law. If you have provided us with a current e-mail address, we may use e-mail to communicate information related to the breach, where permitted. In some circumstances, our business associate may provide the notification on our behalf. We may also provide notification by other methods as appropriate, including substitute or public notice in accordance with applicable law.
B. When This Medical Practice May Not Use or Disclose Your Health Information
Except as described in this Notice of Privacy Practices, or as otherwise permitted or required by law, this medical practice will, consistent with its legal obligations, not use or disclose health information which identifies you without your written authorization. If you do authorize this medical practice to use or disclose your health information for another purpose, you may revoke your authorization in writing at any time. Once we receive your written revocation, we will not use or disclose your information for the purposes described in the authorization, except to the extent we have already relied on it.
All the above categories exclude text messaging originator. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties, excluding aggregators and providers of the Text Message services.
C. Your Health Information Rights
1. Right to Request Special Privacy Protections. You have the right to request restrictions on certain uses and disclosures of your health information by a written request specifying what information you want to limit, and what limitations on our use or disclosure of that information you wish to have imposed. If you tell us not to disclose information to your commercial health plan concerning health care items or services for which you paid in full out-of-pocket, we will abide by your request, unless we must disclose the information for treatment or legal reasons. We reserve the right to accept or reject any other request and will notify you of our decision in writing.
2. Right to Request Confidential Communications. You have the right to request that you receive your health information in a specific way or at a specific location (for example, only at a certain mailing address, through a patient portal, or at a particular telephone number). We will accommodate reasonable requests. To exercise one or more of these rights, contact our Privacy Officer listed at the top of this Notice of Privacy Practices.
3. Right to Access and Obtain Copies. You have the right to inspect and obtain a copy of health information that we maintain about you in a designated record set, with limited exceptions (for example, psychotherapy notes or information compiled for legal proceedings). We may provide copies in paper or electronic form, as available, and may charge a reasonable, cost-based fee as permitted by law. In some situations, we may deny your request, but you may have the right to have the denial reviewed by another licensed health care professional.
4. Right to Request Amendment. If you believe that health information we have about you is incorrect or incomplete, you have the right to request an amendment. Your request must be in writing and must explain why the information should be amended. We may deny your request in certain circumstances (for example, if we did not create the information or if we believe the information is accurate and complete). If we deny your request, you may submit a written statement of disagreement, which we will keep with your record and include in certain future disclosures.
5. Right to an Accounting of Disclosures. You have the right to request an “accounting” of certain disclosures of your health information made by us during a specified period (up to six years prior, not including dates before HIPAA’s accounting requirement applied to us). This accounting will not include disclosures made for treatment, payment, or health care operations; to you; based on your authorization; or for certain other purposes as allowed by law.
6. Right to a Paper or Electronic Copy of This Notice. You have the right to obtain a paper copy of this Notice at any time, even if you have agreed to receive it electronically. You may also request an electronic copy. You can obtain a copy by contacting our Privacy Officer or by visiting our website, where we may post the most current version.
7. Additional Rights Under State Law. Depending on where you live, you may have additional rights under state consumer privacy, health data, or similar laws regarding certain personal information we collect that is not PHI under HIPAA (for example, information collected through cookies, pixels, or other online tracking technologies). These rights may include the right to know what categories of personal information we collect and how we use it, the right to request access to or deletion or correction of certain personal information, and the right to limit certain uses or disclosures of sensitive personal information. D. Changes to this Notice of Privacy Practices
We reserve the right to amend this Notice of Privacy Practices at any time, as permitted by law. Any revised Notice will apply to all protected health information that we maintain, regardless of when it was created or received.
When we make a significant change to our privacy practices, we will update this Notice and post the revised version in a prominent location (for example, on our website and/or at our offices). The Effective Date at the top of the Notice will reflect the latest revision date. Until a new Notice becomes effective, we are required by law to comply with the terms of the Notice currently in effect.
E. Complaints
Complaints about this Notice of Privacy Practices or how this medical practice handles your health information should be directed to our Privacy Officer listed at the top of this Notice of Privacy Practices. You will not be retaliated against or penalized in any way for filing a complaint or exercising your privacy rights.

F. Additional Information About How We Collect and Use Non-HIPAA Personal Information
1. How We Collect Information About You
In addition to PHI, we and our employees and service providers may collect other personal information about you when you visit our websites, use our online services, or otherwise interact with us outside of our role as a HIPAA-covered entity or business associate. We may collect information through online forms, telehealth visits, account registration, letters, phone calls, emails, text messages, voicemails, and the submission of applications or other requests. We may also collect information through cookies, pixels, tags, analytics tools, and similar technologies that help us understand and improve our services.
2. What We Do Not Do With Your Information
Information about your financial situation and medical conditions and care that you provide to us in writing, via email, on the phone (including information left on voicemails), contained in or attached to applications, or directly or indirectly given to us, is held in strictest confidence, consistent with HIPAA and other applicable laws. We do not sell your PHI, and we do not use or disclose PHI for marketing or other purposes that require your authorization unless we have obtained that authorization.
For non-HIPAA personal information, we may share information with service providers and partners who act on our behalf and are contractually required to use the information only for the services they perform for us and to protect it appropriately. If you apply or attempt to apply to receive assistance through us and provide information with the intent or purpose of fraud or that results in an actual or attempted crime, your non-medical information can be given to legal authorities including police, investigators, courts, and/or attorneys or other legal professionals, as permitted by law.
3. How We Use Your Information
Information is only used as is reasonably necessary to process your applications or orders or to provide you with health, pharmacy, or counseling services. This may require communication between myrxhero.com and health care providers, medical product or service providers, pharmacies, insurance companies, and other providers necessary to: verify your medical information is accurate; determine the type of medical supplies or any health care services you need; or obtain or purchase any type of medical supplies, devices, medications, or insurance.
We also use information to operate, maintain, and improve our websites, apps, telehealth platforms, and customer support; to communicate with you about your care, orders, accounts, or inquiries; to comply with legal, regulatory, and reporting obligations; and to protect the rights, property, and safety of you, our patients, our personnel, and others.
4. Cookies and Online Tracking Technologies
Our websites and online services may use cookies, pixels, web beacons, software development kits (SDKs), and similar technologies (“cookies”) to help our sites and services function properly, remember your preferences, understand how you use our sites and services, improve performance and security, and measure and improve the effectiveness of our marketing and advertising.
Some cookies are set by us (first-party cookies) and others may be set by third parties (third-party cookies), such as analytics or advertising providers. Information collected through these technologies may include device identifiers, IP address, browser type, pages viewed, links clicked, and other usage information. 5. Affiliate Programs and Third-Party Links
We may participate in affiliate or referral programs and may provide links to third-party websites or services. 6. Limited Right to Use Non-Identifying Personal Information
Any pictures, stories, letters, biographies, correspondence, or thank you notes sent to us become the exclusive property of myrxhero.com. We reserve the right to use non-identifying information about our clients (those who receive services or goods from or through us) for fundraising and promotional purposes that are directly related to our mission. Clients will not be compensated for use of this information and no identifying information (photos, addresses, phone numbers, contact information, last names, or uniquely identifiable names) will be used without the client’s express advance permission, unless otherwise permitted or required by law.
You may specifically request that no information be used whatsoever for promotional purposes, but you must identify any requested restrictions in writing. We respect your right to privacy and assure you that no identifying information or photos that you send to us will ever be publicly used without your direct or indirect consent, unless otherwise permitted or required by law.
